Terms & Conditions
Introduction
The following terms and conditions (the "Terms") govern all use of the Mania mobile application (the "App") and all content, services, and products available at or through the App (taken together, the "Service"). The Service is owned and operated by Mania. These Terms apply to all users of the Service, including users who are also contributors of content, information, and other materials or services on the Service.
Acceptance of Terms
By using the Service, you represent that you have read, understand, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service. Your use of the Service is also subject to the Privacy Policy, which is incorporated into these Terms.
User Content
The Service may allow users to submit, upload, publish, or otherwise make available content, including but not limited to text, photographs, videos, and audio (collectively, "User Content"). You retain all rights in, and are solely responsible for, the User Content you make available through the Service.
By making any User Content available through the application, you grant to Mania a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit in any manner such User Content in all formats and distribution channels now known or hereafter devised (including in connection with the Service and Mania's business and on third-party sites and services), without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.
You represent and warrant that: (i) you either are the sole and exclusive owner of all User Content or you have all rights, licenses, consents, releases, and powers necessary to grant to Mania the rights in such User Content, as contemplated under these Terms; and (ii) neither the User Content, your submission, upload, publication, or other transmission of the User Content, nor Mania's use of the User Content (or any portion thereof) on, through, or by means of the Service will infringe, misappropriate, or violate a third party's patent, copyright, trademark, trade secret, moral rights, or proprietary or other proprietary rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.
Mania does not endorse any User Content or any opinion, recommendation, or advice expressed therein, and Mania expressly disclaims any and all liability in connection with User Content. Mania does not permit copyright infringing activities and infringement of intellectual property rights on the Service, and Mania will remove all User Content if properly notified that such User Content infringes on another's intellectual property rights. Mania reserves the right to remove User Content without prior notice.
Modifications to Service
Mania reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Mania will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.
Termination
Mania may, in its sole discretion, at any time terminate or suspend all or a portion of the Service, or your use of all or a portion of the Service, with or without notice and with or without cause.
Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MANIA DOES NOT WARRANT THAT THE SERVICE WILL BE AVAILABLE AT ALL TIMES, WILL BE SECURE OR ERROR-FREE, OR THAT THE SERVICE WILL MEET YOUR REQUIREMENTS.
Limitation of Liability
IN NO EVENT WILL MANIA BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF MANIA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, MANIA LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO MANIA FOR THE SERVICE.
Indemnification
You agree to indemnify, defend, and hold harmless Mania, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of your violation of these Terms or your use of the Service.
Governing Law
These Terms and your use of the Service are governed under The United Arab Emirates.
Dispute Resolution
Any dispute arising from these Terms or the Service will be resolved through binding arbitration in accordance with the Dubai Arbitration.
Miscellaneous
These Terms constitute the entire agreement between you and Mania with respect to the use of the Service. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
You agree that these Terms and your use of the Service are governed under The United Arab Emirates. We each agree to submit to the personal jurisdiction of the Dubai Arbitration.
In the event of any conflict between these Terms and any contract you have with Mania, the terms of that contract will control.
Mania's failure to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing.
In the event of any conflict between the English language version of these Terms and a version in any other language, the English language version shall control.
